This should be okay as long as you have an exact overlap between the contact areas of the parent and child cells.

Out of curiosity, why do these DRC rules exist? it does not seem to be related to fabrication or anything
Does it mess up how the vias are placed?
I was getting a similar error for my waffle fet, which is why I flattened the whole thing

The via cuts are generated only within a cell within the drawn contact layer. So if contact areas are not exactly overlapping between a parent and child cell or between sibling cells, then the contact cuts could be in different places and might be partially overlapping or have spacing violations.
